Sue early, sue often. Your girlfriend's claim is for something called unjust enrichment. It's what's called a quasi-contractual remedy. Even though there's no written agreement, your girlfriend preformed part of the contract showing that there must actually be some sort of contract. Get a lawyer and get to court NOW. Your girlfriend is simply an unsecured creditor at this point and will get left holding the bag in bankruptcy unless she files suit. All that family blah blah aside, this is business baby and there's no crying in business. On the insurance issue, there is no issue, you pay enough money you can insure anything whether you own it or not. Collecting on a loss or claim is another matter.
