Ebay is a binding contract and unless the seller and buyer mutually agree to break the contract, it should hold up in court. Ebay is a giant and if there were loopholes in the way it does business that allows people to get away with not delivering a product then it would surely have failed by now. Not to mention the horrible reputation the dealership would develop. If the car isnt handed over by the dealer and the suit is brought to court, you can expect the local media to cover it. Any good businessman would suggest to the dealer that they hand the car over for the agreed upon price because the lawsuit that ensues plus the negative publicity is enough to kill a dealership. Any strong minded consumer knows not deal deal with crooks and will be happy to deal with the second closest dealership to them. After about a month or so of the dealer getting bashed on the web, people stopping at the dealer breaking windows, yelling, waiving signs, calling, etc, etc the dealer did end up selling the car to the ebay auction winner.
